In almost all personal injury claims, insurance companies will offer you significantly less than what you deserve. It’s tempting to accept the first offer, especially if you are in a great deal of pain and unable to return to work. But if you’ve already taken a devalued settlement from the insurance company and your medical bills start to pile up, there’s little legal recourse to ask for more. That’s why it’s crucial to involve a Madison County injury attorney before you even file a claim.

With over 75 years of combined experience, the team at Dennis & Winningham Law will negotiate with the insurance company on your behalf, working tirelessly to secure a more substantial settlement than likely without skilled legal representation. If the adjuster doesn’t offer fair compensation, we can bring a lawsuit against the company. In other words, we will do the legwork so that you can focus on healing.

Case Illustration of Madison County, TN Injury Claim

Located 70 miles east of Memphis, Jackson is the county seat of Madison County, Tennessee. With a population of approximately 70,000, Jackson is considered a regional center for trade in West Tennessee. While Amanda and Patrick Summers were visiting Tennessee from Florida, they decided to eat at the Perkins Restaurant & Bakery on Vann Drive in Jackson. Driving down I-40 from the Hampton Inn Hotel, the Summers family was headed to the restaurant when a semi-truck suddenly changed lanes without properly looking. The truck slammed into the Summers’ vehicle, causing it to spin. Due to the heavy traffic on I-40, the Summers’ car was hit twice more, by other vehicles attempting to avoid the accident.

Following the accident, Amanda was taken to the nearest hospital in Jackson. She suffered injuries to her kidneys, as well as broken bones and a concussion. Due to Patrick’s more severe injuries, he was airlifted to Memphis. It was determined that he had damage to his spinal cord, and would likely expect some level of paralysis for the rest of his life. Neither Amanda nor Patrick was able to return to work for an extended period of time and, in Patrick’s case, the prospect of lifelong medical interventions and rehabilitative therapies was likely. Amanda decided to reach out to Dennis & Winningham Law for an initial consultation. After speaking to an attorney at Dennis & Winningham Law, Amanda felt confident that she could focus on her and Patrick’s health while the legal team took care of their financial future.

Madison County Personal Injury Practice Areas

Accidents usually happen in the blink of any eye, but their consequences can span months, years, or even a lifetime. You shouldn’t have to pay for another’s negligence or bad judgment.

We handle all types of personal injury cases, but the most common include:

  • Car accidents are the most common reason for personal injury claims. All too often, drivers are distracted by their phones or their passengers, or are fiddling with car controls. All of these actions take the driver’s attention away from the road and surrounding traffic, making it much easier for an accident to occur. Other accidents can be the result of driver fatigue or impairment. No matter the cause, car accidents can result in severe or catastrophic injuries.
  • Motorcycle Accidents like bicycle accidents, often result in severe injuries to the cyclist. This is due to the fact that a helmet—if worn—is often the cyclist’s only form of protection. Additional complexities in motorcycle accidents make it extremely beneficial to speak to a knowledgeable Madison County, TN personal injury lawyer from Dennis & Winningham Law.
  • Truck Accidents – In 2020, tn.gov found that one in every six fatal accidents across the state of Tennessee involved a large commercial truck. Trucking accidents that do not result in fatality may result in catastrophic injuries to those in the smaller passenger vehicle, due to the sheer size and weight of a commercial truck. These injuries could include spinal cord injuries, traumatic brain injuries, amputation of limbs, and disfigurement.
  • Boating Accidents According to helpadvisor.com, there were 4,439 boating accidents across the United States in 2021. Though Florida has the most boating accidents by state, other states like Tennessee and Georgia have their share of boating accidents as well. Alcohol is a factor in about seven percent of all boating accidents, while other common causes of boating accidents are operator inexperience or inattention.
  • Premises Liability claims arise when the owner of a property fails to keep the property in good condition, allowing known hazards or dangers to go unaddressed. Premises liability claims can stem from construction site negligence, defective conditions, inadequate maintenance, environmental hazards and toxins, poor lighting or security, ice and snow accumulation, broken locks or defective stairways in hotels, motels, and apartments, and even ceiling collapse. Swimming pools can also be the cause of premises liability concerns.
  • Slip and Fall Injuries are responsible for more than one million ER visits annually. Slip and fall accidents typically occur in public areas where the owner of the property has ignored a specific hazard, failing to either correct the danger or post a warning sign about it. If you have fallen in a grocery store, retail store, bar, restaurant, or other public place as a result of a known hazard, contact Dennis & Winningham Law as soon as possible.
  • Brain Injuries can cause both short and long-term consequences that can range from mild nausea, dizziness, and trouble sleeping to much more severe symptoms, including personality changes, an inability to comprehend written words, and difficulty communicating. If you have suffered a brain injury due to another person’s negligence, contact an experienced Madison County, TN personal injury lawyer from Dennis & Winningham Law today.
  • Bicycle Accidents often have tragic consequences—a bicyclist simply has no protection when hit by a vehicle. While bicyclists are known to be vigilant, a distracted, careless, or impaired automobile driver can cause an accident in the blink of an eye. Following a bicycle accident, the injured bicyclist may have difficulty returning to life as they knew it before the accident, possibly coping with their injuries for the rest of their life.
  • Nursing Home Abuse has become a serious problem across the United States. Nursing home abuse can come in the form of physical, mental, psychological, financial, or sexual abuse. While emotional and mental abuse tend to be the most common, physical abuse is not far behind. After entrusting your loved one to the care of someone else, it can be devastating to learn that they are not safe.
  • Burn Injuries can result in months or years of recovery. In some cases, burns can be so severe that the victim suffers constant pain. Victims may also experience emotional trauma due to their disfigurement. If you or a loved one has been the victim of burn injuries caused by another person’s negligence, Dennis & Winningham Law can help you through this very difficult time.
  • Wrongful Death claims are made by certain family members in order to recoup losses after a loved one dies due to another person’s negligence. In Tennessee, personal representatives for the estate on behalf of family members may also make wrongful death claims. It can be extremely beneficial to have a Madison County, TN personal injury lawyer in your corner to fight for your family’s rights while you are allowed the time you need to grieve your loss.
  • Uninsured/Underinsured Motorist Coverage is particularly useful in a state like Tennessee where as many as 25% of all drivers are uninsured. If you carry uninsured/underinsured motorist coverage on your insurance policy, then you can file a claim with your insurer that will cover your damages in the event that the at-fault party has little or no insurance.

Motor vehicle and car wreck accidents are among the most common causes of accidental injury, and neck and back injuries are frequent in these accidents. Injuries to the neck and back often require more time to heal, which means more medical treatment, more pain and suffering, and more time out of work. In these cases, it’s always in your best interest to hire a Madison County personal injury attorney without delay.

Do I Have a Valid Madison County, TN Accident Claim?

When determining the validity of your injury claim, your Madison County, TN personal injury lawyer will consider several factors. The first of these is whether liability is clear—that is, was the person who caused your accident clearly negligent? The extent of your injuries is a factor as well, in addition to the length of time that you can expect to be unable to attend work. If you will require medical treatment for a very long time, this will also be a factor in your accident claim.

Following your accident, it is imperative that you consult a Dennis & Winningham Law attorney. The legal team will instruct you to avoid such things as posting about your accident on social media or speaking to an insurance adjuster from the at-fault party’s insurance company. If your attorney determines that there is sufficient evidence to show liability and that your injuries warrant significant damages, then you have a valid accident claim.

The regional area of Georgia and Tennessee is a crossroads and a center for car manufacturing, river traffic, and other industries. Large trucks, semi-trucks, 18-wheelers, and other commercial vehicles are constantly on the road. This has a downside as frequent truck accidents occur on I-75, I-24, I-59, Highway 153, U.S. 27, Amnicola Highway, Corridor J, and other roadways. ATV Accidents

Under both Tennessee and Georgia law, ATVs are not authorized for use on paved road, but children continue to bring ATVs on to our roads and highways. Georgia and Tennessee laws also prohibit the carrying of passengers on most ATVs, require children below the age of 16 to take approved ATV training courses, and require kids younger than 16 to wear helmets, eye protection, and over-the-ankle boots when operating ATVs. However, these requirements apply only when ATVs are operated on public lands, leaving kids essentially without protection when riding ATVs on private property.

About ATV Accidents >

Bicycle Accidents

The most tragic type of bicycle crash is a bike-car collision. Cyclists are completely defenseless traveling on 30-pound bikes when they’re surrounded by 3,000-pound cars and trucks racing by them. Pedestrians, defective bike parts, recalled bike helmets, and other ineffective bicycle safety equipment can also cause bicycle accidents. Bike accidents can result in wrongful death or serious injuries such as broken bones, amputation, traumatic brain injury, neck, back, and spinal cord injuries.

About Bicycle Accidents >

Boating Accidents

One of three factors usually cause boat accidents: an inexperienced boater, an intoxicated operator, or a boat malfunction. More than a third of both fatal and non-fatal boat accidents are alcohol-related. It is estimated that boat operators with a blood alcohol content of .10 or higher are 10 times more likely to be injured or killed in a boat accident than sober operators.
